Workers' Compensation
If your injury occurred at work, your employer's workers' compensation insurance may be available to cover a portion or even all of your medical expenses.
Federal and state regulations mandate that companies carry workers’ compensation insurance in case their employees are injured or become ill at work. Although this coverage is a requirement for all U.S. businesses, individual states have the ability to determine certain aspects of coverage pertaining to work-related injuries or illnesses. Because of the complexity of workers’ compensation claims, we strongly recommend contacting an attorney if you have been involved in a work-related accident.
Chapter 440, F.S. of Florida law requires employers to obtain and retain the appropriate workers’ compensation insurance coverage for employees. The state agency responsible for ensuring that employers adhere to this requirement is the Bureau of Compliance.
Workers' compensation benefits are available to most employees who suffer an injury that occurred in the course of their employment. Work-related injuries typically covered by workers' compensation include, but are not limited to:
- Neck, Back, and Knee Injuries
- Hearing Problems
- Eye Injuries
- Work-Related Emotional Problems
- Asthma or Other Work-Related Pulmonary Conditions
- Work-Induced Heart Attack or Stroke
- Occupational Diseases such as Asbestosis and Dermatitis
- Carpal Tunnel and/or Repetitive Trauma Injuries
- Loss of Use of Limbs
After a work-related accident happens, you must file a claim through your employer’s workers’ compensation insurance as soon as possible. Once the claim has been filed, your employer and your employer’s insurance carrier will assess the claim to determine if the injury was work-related or not. Either your employer or your employer’s workers’ compensation insurance can accept or reject the claim. In addition, if your accident is reported more than 30 days after it occurs, your claim may be denied.
