Premises Liability

By law, property owners are required to provide a safe environment for individuals who visit the premises. This includes performing routine maintenance and preventing dangerous conditions.

Premises liability is the area of law that governs injuries such as slip and fall accidents that occur on real property. This type of liability is specialized and used to determine which party is at fault for the injury (or injuries) that occurred. Once this is determined, the person or company in possession of the land or premises may be responsible for injuries suffered on that property.

Property owners, including business owners, are required to provide a safe environment for individuals who visit the property. This includes everything from a large home repair warehouse to a small convenience store. If you sustain an injury on property other than your own, premises liability laws afford you protection.   • Were you paying full attention at the time of the accident?
  • Was poor or dim lighting the cause or partial cause of the accident
  • If you slipped on a spill in a mall, was it there long enough that the property owner should have been aware of it?
  • Would a reasonable person have been able to avoid the slip and fall accident?
  • Was the spill area properly labeled or marked?
  • Is there a standard cleaning or maintenance schedule for the premises? If so, can the property owner prove that the policy exists?
  • If, for example, you tripped over a stack of boxes beside a shelf in a grocery store, were the boxes there for good reason? Was their placement a danger to customers, and/or should a proper barrier or warning sign have been set up?
  • Was the shelf stacked too high?
  • Were safety nets or guardrails in place on the higher shelves?
