Should Toyota Face Criminal Penalties for not Disclosing the Truth about its Safety Issues?
 |
| Brian
F. LaBovick, Esq.
| |
Since
the start of 2010, Toyota has undergone a number
of charges, investigations, and a rash of consumer
backlash. Everything from jammed floor mats
to sticky accelerator pedals to allegations
of electronics as the root of all evil have
left the Toyota brand tarnished and frayed.
With unintended acceleration linked to some
34 or more deaths, however, the carmaker's woes
are far more serious than the cost of any recall.
Should
Toyota face criminal penalties for allegedly
knowing about the sticky accelerator issue and
not fully disclosing this information to the
U.S. government? Follow the link to read Attorney
Brian LaBovick’s blog post answering this
key question.

Personal
Injury and Cell Phone Use While Driving
Cell
phone usage has increasingly become a contributing
factor of accidents, resulting in an increase
in personal injury litigation involving cell
phones. When an employee is driving and using
a cell phone at the time of an accident, and
the call is business related or the cell phone
was provided by the company, the employer could
be liable along with the driver for any personal
injuries caused.
Studies
show that driving while using a cell phone reduces
the amount of brain activity associated with
driving by 37 percent. Driver distractions accounted
for 5,870 deaths and an estimated 515,000 personal
injuries that involved police crash reports
in 2008, according to the NHTSA.
