MAKERS OF YAZ FOUND TO BE IN VIOLATION OF FEDERAL ACT

Ads misled consumers about serious side effects of drugs.

In October 2008, the U.S. Food & Drug Administration’s Department of Health & Human Services (HHS) sent a warning letter to Bayer HealthCare Pharmaceuticals, Inc. (Bayer) regarding the company’s YAZ birth control. The letter states that several of Bayer’s advertisements involving YAZ were misleading because they “broaden the drug’s indication, overstate the efficacy of YAZ, and minimize serious risks associated with use of the drug." Because of this, the HHS found Bayer to be in violation of the Federal Food, Drug, and Cosmetic Act in conjunction with Bayer’s misbranding of YAZ.
